Defamation is a false disparaging statement, that is published either online or otherwise communicated orally or in writing.
IPC says – Defamation takes place by words either spoken or intended to be read, or by signs or by visible representations, to make or publish any imputation concerning any person intending to harm, or knowing or having reason to believe that such imputation will harm.
While recently Defamation was included in the Information Technology Act also, to cover matters for ‘Cyber Defamation’ under Section 66A but has been subject of servere criticism in media since arrests of two young ladies by Mumbai Cyber Crime Police in Nov 2012 due to the lack of detailed provisions.
